Welcome to Le Cake Shop. By placing an order through our website, you are agreeing to the terms set forth below. These terms are intended to ensure both your satisfaction and our ability to provide excellent service and products.
1. Acceptance of Terms
This website is owned and operated by Le Cake Shop. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors custom cake design and ordering services online. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
2. Services Description
Le Cake Shop provides custom cake design and ordering services online. Detailed descriptions of our products are available on our website.
3. User Obligations
You must provide accurate and complete information when placing an order. You are responsible for maintaining the confidentiality of your order confirmation details.
4. Prices
All prices are non-negotiable and set according to your order, specific design, and the size of your product.
Following an enquiry, a quote is valid for 14 days. Le Cake Shop cannot guarantee an order and time slot until a deposit has been paid. If more than 48 hours have elapsed since the original quote, please check availability before you pay your deposit to avoid disappointment.
5. Deposits, Balance of Payments
A non-refundable 50% deposit (total value of the product and full delivery price, if applicable) is required to secure your order and chosen date with Le Cake Shop. Collection times will be agreed upon with Le Cake Shop and depend on the availability of time slots on that date. During peak times (e.g., Christmas, Mother’s Day), there will be set collection times.
Once an enquiry has been made, the deposit needs to be paid within 24 hours to secure your order. We reserve the right to cancel any request if the payment is not made within this time frame.
Le Cake Shop retains the right to cancel the booking under exceptional circumstances beyond their control, such as fire or ill health. In such cases, a full refund of any monies paid will be made as soon as practically possible.
The deposit upon placement of your order will be deducted from the total value of your order. The balance is payable one week before collection or delivery, if offered.
Deposits are non-refundable and non-transferable. Any requested changes in design, date, and collection time are at the discretion of Le Cake Shop and may not always be possible.
When ordering online, full payment is required at the time of ordering. We accept various payment methods as listed on our website.
6. Advance Ordering
To avoid disappointment, please give as much notice as possible for your order. However, we will accept short-notice orders subject to availability.
Each product is made to order, so although every effort is made to ensure consistency, small variations may occur in the colour and design requested.
7. Best Before Date / Storage Conditions
Our products are baked to ensure they are fresh on the date of your event (if advised of the date) and not just for the date of collection.
We cannot guarantee the quality if the product is consumed more than 24 hours after the event.
Your products must be kept at room temperature in a cool, dry room and must not be refrigerated.
Le Cake Shop will not be held liable if items are not consumed within the recommended timeframe or are stored incorrectly. It is the purchaser’s responsibility to ensure the storage conditions are adhered to.
8. Non-edible Items
Some products contain non-edible items. You will be informed if your product includes a non-visible item such as cake support dowels. It is the customer’s responsibility to ensure these are removed before consumption (e.g., support dowels in tiered cakes, ribbons, and cake toppers).
9. Collection and Delivery
Products can only be collected from our premises at the prearranged time and date. The collection address for all orders is in New Milton, and the full address will be provided to you upon placement of your booking.
Products will only be considered for delivery on orders exceeding £250 and will be subject to availability. Delivery charges apply and depend on the time and distance to the venue, with a minimum delivery charge of £10.00 for up to 5 miles.
It is your duty to examine the product upon collection/delivery to ensure that the order is intact and that the products have not been damaged in transit if we make the delivery. We do not accept any liability for product damage once it has left our control.
You are required to enter full and accurate details for delivery including the name, address, and postcode. We will not be responsible for any orders that are not delivered due to incorrect or incomplete information being supplied by you.
If no one is present to receive the delivery at the agreed delivery date and time, it will be deemed a ‘Failed Delivery’. The product will be returned to Le Cake Shop and you will be responsible for collecting the product from the business premises in New Milton. We are unable to refund the order cost or
10. Ingredients and Special Dietary Requirements
All our ingredients are of the highest quality and freshly prepared without the use of any preservatives in the sponge.
Product ingredients can include eggs, flour, cocoa, sugar, milk, margarine, and butter.
Note: if a colour other than natural buttercream is requested, there will be food colour additives in the buttercream. If you require more information about colour additives when considering placing an order, please contact us to discuss. A comprehensive list of food colour additives used is noted in the allergens section below.
11. Allergens
Please be aware that although ingredients such as nuts and other allergens may not be in the products, they are still used in our kitchen, so Le Cake Shop cannot guarantee that any of our products are allergen-free. If you choose to place an order, this will be at your own risk.
Allergens noted in bold:
- Celery, cereals containing gluten, crustaceans, eggs, fish, lupin, milk, molluscs, mustard, peanuts, sesame, soybeans, sulphur dioxide and sulphites, and tree nuts.
Professional Food Colours are used in the buttercream in Le Cake Shop products, which vary from product to product depending on the colour choices made. The food colour manufacturers state that various allergens are used in the factories producing their products and therefore cannot guarantee they are allergen-free.
Food Colourants contain various ingredients and additives which can include the following. If you need information about specific colours for your order, please contact Le Cake Shop.

12. Intellectual Property
All content included on the site, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the site, is the property of Le Cake Shop or its suppliers and protected by copyright and international conventions.
13. Limitation of Liability
Le Cake Shop will not be liable for any damages that arise from the use or inability to use our services or products.
Quality Assurance

Our cakes are hand-made and unique. Slight natural variations in appearance are to be expected.

We reserve the right to replace unavailable components with those of equal or better quality.

At the time of collection or delivery, you will be asked to inspect the cake. We urge you to check the appearance of the cake carefully and contact us immediately if there are any defects.
Consequential Costs

We strive to ensure that your cake meets your expectations and is delivered in perfect condition.

In the unlikely event of any issues, we will take reasonable steps to rectify the situation to your satisfaction.

However, Le Cake Shop does not accept responsibility for consequential costs or emotional distress due to errors with our products or delivery. This exclusion does not affect your statutory rights.
14. Governing Law
These Terms of Service and any dispute arising out of your use of our website are governed by the local laws applicable to our business location.
15. Changes to Terms
Le Cake Shop reserves the right, at our sole discretion, to modify or replace these Terms at any time.
